Who This Policy Covers
This Privacy Policy applies to GigGenius users, visitors, clients, Geniuses, affiliates, course participants, and people who contact our support team. GigGenius is intended only for people who are at least 18 years old. We do not knowingly create accounts for minors.
Information We Collect
- Account and contact details, including name, email address, mobile number, country, date of birth, and login records.
- Genius profile, client profile, company, portfolio, skill, education, work-history, job, proposal, contract, course, and review information.
- Identity-verification information, including government identification, selfies, facial-verification results, business-registration documents, and verified PWD documentation when voluntarily submitted.
- Payment, funding, wallet, payout, withdrawal, refund, dispute, invoice, and transaction records. GigGenius does not store complete card credentials when processing is handled by a payment provider.
- Technical and security information such as IP address, device and browser details, access logs, cookies, and fraud-prevention signals.
- Desktop App activity data while the timer is running: keyboard and mouse input counts and timing, the active application and window title, idle periods and the purpose you select, and signals used to detect automated input (Draft).
- Messages, support requests, reports, dispute evidence, affiliate referrals, and communications sent through the platform.
How We Use Information
- Create and secure accounts, verify identity and eligibility, and prevent impersonation, fraud, abuse, and off-platform payment circumvention.
- Operate profiles, job posts, proposals, contracts, courses, double-blind reviews, affiliate tracking, support, and platform communications.
- Process contract funding, payment confirmation, wallet credits, payment release, fees, withdrawals, refunds, disputes, and financial reconciliation.
- Maintain legal, accounting, security, audit, and compliance records and improve platform reliability.
Facial and Identity Verification
Identity verification may compare a selfie or live facial image with an identification document and may use automated checks followed by manual review. Verification information is used only for identity, eligibility, security, fraud prevention, and compliance purposes. Access is restricted to authorized personnel and service providers with a legitimate operational need.
Desktop App and Time-Tracking Data (Draft)
- What we collect: only while the timer is running, keyboard and mouse input counts and timing, the active application name and window title, idle periods, the idle purpose and optional note you provide, and technical signals that indicate whether input came from a physical device or from software.
- What we do not collect: the content of your keystrokes, passwords, or messages. The Desktop App does not take screenshots or record your screen, camera, or microphone at launch. If any such feature is offered later, it will be optional, disclosed in advance, and require your separate consent.
- How it is used: to calculate time segments and productivity scores, detect automated or simulated input, support client approvals, unpaid-day decisions, disputes, and fraud prevention, and improve the accuracy of the tracker.
- Who can see it: the client on the contract sees time segments, scores, labels, flags, and any idle purpose you choose to share. Detailed window titles are visible only to you and to authorized GigGenius staff reviewing a dispute or fraud case.
- Your choices: you consent when you start the timer and may stop tracking at any time by stopping the timer. You may delete segments before submission; deleted segments are not billed but are kept in an audit record.
- Offline and security: segments recorded without an internet connection are stored encrypted on your device and uploaded when the connection returns. Data is encrypted in transit and protected by access controls.
- Retention: detailed activity data is kept for up to 12 months after the related week, and for longer only when needed for an open dispute, a fraud investigation, or legal obligations. Time and payment records are retained as described in Retention and Deletion.
Payments, Wallets, and PayCools
PayCools is the current external payment-processing provider used for supported funding transactions. PayCools may receive information required to create a payment request, confirm payment status, verify callbacks, prevent fraud, and reconcile a transaction. GigGenius records provider references and transaction states so funding, escrow, releases, refunds, disputes, wallet credits, and withdrawal requests can be administered accurately.
Funding, Releases, Refunds, and Disputes
- One-time contracts require full advance funding before work begins.
- Milestone contracts require the active milestone to be funded before work begins on that milestone.
- Hourly contracts require one week of advance funding before the time tracker is enabled; the platform workweek is Monday through Friday, Eastern Time.
- Released amounts are credited to the Genius wallet after the applicable platform fee. Refunds, cancellations, disputes, chargebacks, partial settlements, and withdrawals create records that may need to be retained for legal and financial accountability.
Affiliates, Courses, and Reviews
Affiliate codes and attributed activity are processed to calculate eligible commissions. Course progress, viewing requirements, quiz attempts, scores, and completion records are processed to provide learning features and enforce entry-level eligibility rules. Contract reviews are double-blind during the review period and are published according to the User Agreement.
Retention and Deletion
Profile and account information is retained while an account is active and for a reasonable period afterward. Identity, contract, payment, wallet, payout, refund, dispute, tax, security, and audit records may be retained longer when required for legal obligations, fraud prevention, accounting, claims, or enforcement. Valid deletion requests remove or anonymize information that is no longer required; they do not override mandatory financial, security, dispute, or legal retention.
Your Rights and Choices
- Request access to or correction of your personal information.
- Request deletion, restriction, objection, or data portability where applicable.
- Withdraw optional consent without affecting processing already lawfully performed.
- Manage communication preferences and submit a privacy complaint or verification question.
Security and Contact
We use access controls, encryption in transit, restricted administrative permissions, logging, backups, and monitoring intended to protect information. No online system is risk-free. Report privacy or security concerns through the Contact or Help page so the authorized team can investigate.
