User Agreement

Last updated: October 16, 2026

This agreement defines the responsibilities of clients, Geniuses, affiliates, and other users participating in GigGenius workflows.

Agreement and User Relationship

This User Agreement applies to clients, Geniuses, and users participating in GigGenius transactions. Users contract with each other for services; GigGenius provides the platform, verification, communication, funding, tracking, wallet, review, course, affiliate, and dispute workflows.

Accurate Information and Privacy

Each user must provide accurate account, identity, profile, company, job, proposal, contract, and payout information. Public profiles must not expose private contact details. Users may use information obtained through GigGenius only for legitimate platform activity and must protect confidential and personal information.

Credits and Applications

  • Clients and Geniuses receive only the job-post and proposal credits stated in the current platform workflow.
  • One proposal uses one proposal credit. Eligible credits may be returned after rejection, withdrawal, expiry, or a filled job.
  • Credits have no cash value and cannot be sold, transferred, or manipulated.
  • Entry-level Geniuses must complete the three required free courses before job applications are enabled.

Offers and Contracts

A contract begins only after required acceptance and funding conditions are satisfied. Contract type, scope, rate, deliverables, milestones, weekly limits, deadlines, and hiring slots must be recorded accurately. Users must not create sham contracts or transactions.

Funding Requirements

  • One-time: the full contract amount must be funded before work begins.
  • Milestone: the active milestone must be funded before work begins on that milestone.
  • Hourly: one week must be funded in advance before the timer is enabled; the platform workweek is Monday through Friday, Eastern Time.
  • A client may create a job post before funding, but covered work must not begin until the applicable funding requirement is met.

Desktop App, Time Review, and Unproductive Days (Draft)

By starting the timer in the GigGenius Desktop App, the Genius consents to activity verification while the timer is running, as described in the Privacy Policy. Tracking stops when the timer is stopped. The Genius is responsible for reviewing segments before submission and may delete segments they do not wish to bill. Idle time may be billed only when its purpose is stated and accepted by the client.

The client is responsible for reviewing submitted time promptly. The client may approve or reject time by day or by segment, and may decline payment for an unproductive day only by recording a reason. GigGenius notifies the Genius, who may respond or open a dispute. Productivity scores and automated-input flags are review aids, not final decisions; disputed amounts are held in escrow and resolved through the Cancellations, Refunds, and Disputes process.

Payment Processing and Release

PayCools is the current supported payment processor for applicable funding transactions. Provider callbacks and references are used to confirm status and prevent duplicate settlement. Funds may be held until release conditions are met. When payment is released, the platform fee is deducted and the net amount is credited to the Genius wallet.

Platform Fees

The standard platform fee is 10% of released Genius earnings. A Genius whose PWD status is approved by an authorized administrator receives a 5% fee rate while that verification remains active. Fees are calculated at release and are recorded with the related contract and wallet transaction.

Wallets and Withdrawals

Wallet balances reflect recorded credits and debits, not unconfirmed provider activity. Withdrawal requests may require payout details, identity checks, review, minimums, conversion, provider fees, and processing time. Users are responsible for supplying correct payout information.

Cancellations, Refunds, and Disputes

Users must use the platform workflow and provide requested evidence. Depending on funded value, work completed, acceptance, provider status, and applicable law, an outcome may include release, partial release, hold, cancellation, refund review, or manual provider processing. Disputed amounts are not treated as completed earnings unless and until released.

Courses and Progression

Course progress, required viewing, quiz attempts, scores, and completion are recorded. Required material may not be skipped or falsified. Entry-level status cannot be manually upgraded by the user; advancement is available only after the required three courses and platform eligibility rules are completed.

Double-Blind Reviews

Reviews are available only after contract completion. Submissions remain hidden during the double-blind period. If one party submits, the other party has seven days to respond. After the period closes, the review is final and non-editable; only an authorized administrator may remove it after investigation.

Affiliate Participation

Eligible affiliate activity may earn the current published commission. Commissions may be delayed, reversed, or denied for refunds, chargebacks, fraud, self-referrals, duplicate accounts, attribution failure, or violations. Affiliate earnings become withdrawable only after applicable confirmation and review.

Records and Administrative Action

GigGenius may preserve, correct, export, restrict, or delete records when authorized and lawful. Permanent owner-level deletion requires explicit confirmation and an audit record. Financial, dispute, verification, tax, and security records may be retained when deletion would conflict with legal, accounting, fraud-prevention, or user-protection duties.

Governing Law

This User Agreement is governed by the laws of the Republic of the Philippines. Any provision that cannot lawfully be enforced will be limited or removed without invalidating the remaining provisions.
