Eligibility and Acceptance
You must be at least 18 years old and legally capable of entering a binding agreement to use GigGenius. By creating an account or using the platform, you agree to these Terms, the Privacy Policy, and the User Agreement.
Accounts and Verification
- Provide accurate, current information and keep credentials secure.
- Complete required identity, facial, business, or PWD verification truthfully.
- Do not sell, share, impersonate, duplicate, or transfer an account.
- GigGenius may review, restrict, suspend, or close accounts to protect users and enforce these Terms.
Roles and Profiles
Users may access Genius or client functions for which they are eligible. Contact details must not be displayed publicly. Profile, portfolio, company, job, proposal, and credential information must be accurate and must not violate another person’s rights.
Jobs, Proposals, and Credits
- Job posts may be reviewed, unpublished, or expired after 30 days of inactivity.
- Clients receive the platform’s stated number of job-post credits; Geniuses receive the platform’s stated proposal credits and application limits.
- Credits are platform permissions, not cash, and may be returned or replenished under the published workflow.
- Clients may not apply to their own or other clients’ jobs as a Genius.
Contracts and Advance Funding
Posting a job does not itself require funding. A client must fund the applicable contract amount before covered work begins. One-time contracts require full advance funding. Milestone contracts require the active milestone to be funded before work begins on that milestone. Hourly contracts require one week of advance funding before the timer is enabled; the workweek runs Monday through Friday, Eastern Time.
Payments, Fees, and Wallets
- Supported payments are processed through PayCools and other providers GigGenius may formally approve.
- The standard Genius platform fee is 10% of released earnings. An admin-verified PWD Genius receives the 5% rate while eligibility remains approved.
- Funding may be held pending contract performance, acceptance, release, cancellation, refund, dispute, or provider confirmation.
- A successful release deducts the applicable platform fee and credits the net amount to the Genius wallet.
- Withdrawal availability, processing time, currency conversion, and external provider fees depend on the selected payout method and compliance review.
Hourly Work and Time Tracking
Hourly time must be recorded through the approved tracker, including the GigGenius Desktop App when it is available, and remain within the contract’s weekly limit. A Genius may not run simultaneous timers for different clients. False, duplicate, inflated, automated, or unsupported time may be rejected and may lead to account action.
Desktop App and Activity Verification (Draft)
- The GigGenius Desktop App records hourly time in 10-minute segments and verifies activity using keyboard and mouse input counts and timing, the active application and window title, and idle periods. It does not record the content of keystrokes and does not take screenshots at launch.
- Using software, scripts, devices, or other methods that simulate human input, or otherwise misrepresent activity, is prohibited. Segments with signs of automated input may be flagged, withheld from payment, and reviewed, and may lead to account action.
- When idle time is detected, the Genius may state its purpose and choose whether that purpose is shown to the client. Idle time without an accepted purpose may not be billed.
- Before submitting time, a Genius may delete any segment they do not wish to bill. Deleted segments are not charged and are kept in an audit record for dispute review.
- Manual time becomes available only after the contract’s weekly tracked hours have been used, counts toward the weekly limit, and may be declined by the client.
- A client may approve or reject time by day or by segment and may decline payment for a day it considers unproductive only by giving a reason. The Genius is notified and may respond or open a dispute. Funds for disputed time remain in escrow until the review is complete.
Deliverables and Acceptance
Users must communicate in good faith, submit work through the contract workflow, and review deliverables promptly. Release does not waive rights arising from fraud, a valid dispute, or a provider reversal.
Cancellations, Refunds, and Disputes
Cancellation and refund outcomes depend on work completed, funded amounts, accepted deliverables, evidence, provider status, and applicable law. Users must cooperate with dispute review. GigGenius may hold, partially settle, release, or recommend refund treatment based on the record; provider-side refunds may require manual processing.
Reviews
Reviews become available only when a contract is completed. They are double-blind during the review period. If only one party submits, the other has seven days to respond; after the period closes, reviews cannot be added or edited. Reviews may be removed only by an authorized administrator after investigation.
Courses and Entry-Level Eligibility
Entry-level Geniuses must complete the three required free courses and satisfy the published completion rules before applying to jobs or advancing their profile level. Course videos, progress, quizzes, and completion records may not be bypassed, manipulated, or falsified.
Affiliate Program
Affiliate commissions apply only to eligible, attributable activity under the current program rules. Self-referrals, fabricated accounts, manipulation, chargebacks, refunds, or prohibited activity may void commissions.
Prohibited Conduct
- Fraud, harassment, discrimination, illegal activity, malware, scraping, or security interference.
- Sharing private contact information to avoid the platform workflow or arranging prohibited off-platform payments.
- Misrepresenting identity, skills, credentials, company details, work, hours, earnings, reviews, or referral activity.
- Publishing confidential information or content that infringes intellectual-property or privacy rights.
Suspension and Termination
GigGenius may restrict features, pause transactions, preserve evidence, suspend, or terminate access for safety, legal, payment, verification, or policy reasons. Contract, payment, dispute, and retention obligations may survive account closure.
Disclaimers and Liability
GigGenius provides a platform and workflow but is not the employer, agent, or guarantor of users. To the extent permitted by law, services are provided as available and liability is limited to direct losses legally attributable to GigGenius. Nothing in these Terms removes rights that cannot lawfully be excluded.
Governing Law and Contact
These Terms are governed by the laws of the Republic of the Philippines. Courts or lawful dispute mechanisms with jurisdiction in the Philippines will apply unless mandatory law requires otherwise. Questions may be submitted through the Contact or Help page.
